All products offered on the Site are subject to availability. We reserve the right to discontinue any product at any time or update information to correct errors, inaccuracies, or omissions at any time without prior notice. If a product is out-of-stock at the moment you have placed an order, we will contact you to choose another product or get refunded.
2.2 Pricing
All prices are listed in EUR(€), USD($) or GBP (£). They are inclusive all applicable taxes and subject to change without notice. We strive to ensure that all pricing information on the Site is accurate, but errors may occur. If we discover an error in the price of any product you have ordered, we will inform you as soon as possible and give you the option to reconfirm your order at the correct price or cancel it.
2.3 Payment
We accept PayPal payments and major international credit cards. By providing a payment method, you represent and warrant that you are authorized to use the designated payment method and authorize us to charge your payment method for the total amount of your purchase, including any applicable taxes and shipping fees. You shall provide Dress & Design with accurate and complete billing information including full name, address and country of residence.
2.4 Newsletter
If you participate in one of our contests or place your first order without having subscribed to our newsletter, you will be automatically added to it in order to benefit from our welcome discount. You can unsubscribe from the newsletter at any time.
2.5 Termination
We reserve the right to refuse or cancel your order at any time for certain reasons including but not limited to product or service availability, errors in the description or price of the product or errors in your order.
3. Confidentiality and Privacy
3.1 Privacy
We apply strict data protection. Please see refer to our privacy policy at dressndesign.com/privacy.
3.2 User-created pictures and videos
Garments that you have created yourself on our site, through combining a model with a chosen fabric are kept confidential unless you have posted yourself pictures of them on public social media platforms in which case we might use your pictures as examples of user-created content on our dressndesign.com website or related social media pages, channels, or mobile applications.
3.3 Testimonials
You can request by email the modification or removal of your testimonial which has been posted directly to the dressndesign.com website at any time and without any conditions.
4. Shipping and Delivery
4.1 Shipping
We ship worldwide to countries listed on our website. Delivery time vary between 1 and 4 weeks, depending on the destination and types of products but can experience delays over which we have no control.
4.2 Delivery
Delivery is in-person. In the rare case where a parcel is reported to be lost by the carrier, we will contact you can choose to have the product resent or refunded.
5. Refunds
5.1 Returns and Exchanges
Items cannot be returned or exchanged since our products are customized or custom-made. Dresses are made-to-measures or have detailed size and length information to ensure that they fit you well.
5.2 Damaged Items
Items are checked for defects and packed carefully before shipping. In the rare case where an item arrives damaged, please contact us with the picture of the damaged item within 7 days of your package being delivered. Your item must be in the same condition that you received it, unworn or unused, with its tag and original packaging. Once the pickup of your returned item is completed, we will email you the voucher within 2 business days which you can use without product or time limitations.
6. Intellectual Property
The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Dress & Design and its licensors and are protected by the laws of France and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
7. Disclaimers and Limitation of Liability
7.1 Disclaimer of Warranties
The Site and all content, products, and services available on the Site are provided on an “as is” and “as available” basis without any warranties of any kind, either express or implied. We do not warrant that the Site will be uninterrupted or error-free.
7.2 Limitation of Liability
To the fullest extent permitted by law, in no event shall Dress & Design, its directors, officers, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use or inability to use the Site; any unauthorized access to or use of our servers and/or any personal information stored therein; any interruption or cessation of transmission to or from the Site; any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Site by any third party; or any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Site.

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law principles. You agree to submit to the personal jurisdiction of the courts located in for the purpose of litigating all such claims or disputes.
